June 22, 2024 Bermas & McGreevy Discuss Dr David Hartsuch vs. Iowa Boards of Medicine & Pharmacy



On the 22 June 2024 broadcast, Jason Bermas talks with Todd McGreevy about the trials and tribulations of David Hartsuch MD MS, specifically his lawsuit against the Iowa Boards of Medicine and Pharmacy. Dr Hartsuch’s ordeal began in November 2021, when he was included in at least 17 Iowa doctors being investigated by the Iowa Board of Medicine for purportedly spreading misinformation about COVID-19 and off-label prescription usage to treat said disease. With this June 17, 2024 filing in the Iowa Supreme Court, Hartsuch’s original action and the facts around this case that were previously required to be confidential due to hypocritical policies at the aforesaid board and the Iowa Board of Pharmacy are now in the public domain.

In Hartsuch’s case when his patient complained to the Board of Pharmacy about being discriminated against by not filing an ivermectin prescription, and disclosing, after being asked by the pharmacist, that it was to treat COVID-19, that complaint was dropped by Pharmacy Board and an investigation of the prescribing doctor, Hartsuch, was instigated by the Board of Medicine instead. Hartsuch’s case asserts to the courts that the Boards practiced invidious discrimination based on dodgy conclusions against his patient and that these abuses by the boards are about an even bigger picture related to First Amendment protected speech rights for all Iowans. Hartsuch’s original filing to the Iowa Supreme Court was filed as confidential to which the court issued an order that read in part: “Within 10 days of the filing of this order appellant shall file an amended reply brief which removes any confidential information so that the reply brief is accessible to the public. The supreme court clerk shall maintain the security level of the May 28th reply brief at security level 2.”  Dr Hartsuch amended his reply brief to include affidavits from fellow-physicians like Lee Merritt MD, and from witnesses whose own refusal of prescription had their unfortunate real-world consequences.
Dr Hartsuh’s defiance of the legal gag-orders served him, and others in the same professional boat, have been shown to have eerie prescience, particularly in what we’ve since learned about COVID-19 and the medical establishment’s tragicomic approach to treating it en masse. In a 4 August 2021 letter to the Quad-City Times, Dr Hartsuch concluded, “Americans should not go quietly to the grave, paying scientists to send us there.” That seems more and more like sound medical advice as the days go by.
